The last year or two though,... owners have been causing damage to these garden areas and walkways and the body corporate is doing nothing to stop it. Veldfire prevention through firebreaks – the duty to prepare and maintain fire breaks in terms of Chapter 4 of the National Veld & Forest Fire Act, 101 of 1998 (“the Act”)

These particular provisions of the Act place a duty on owners of a property to prepare and maintain firebreaks on... the boundary of their property, failing which they risk exposing themselves to potential delictual and civil claims being instituted against them by their neighbours. The public can seek advice from the legal profession to assist them in lodging a potential claim against their neighbour in circumstances where such neighbour has failed to take adequate steps to create and maintain firebreaks on their property.

Application of the National Credit Act to property instalment sale agreements

A buyer is interested in buying my flat. Her bank is not prepared to give her a loan because she... is paying off a few personal loans, but she is prepared to enter into an instalment sale agreement to pay the purchase price in instalments over a period of time, much like a rental. I like the idea of at least getting a monthly income, but I am worried whether I can do this and charge interest on the instalments, particularly as it will take a few years for her to pay the price in full?
