The relationship between settlement agreements and the National Credit Act (NCA) - Where the underlying reason for a settlement agreement... is not governed by the NCA, the agreement itself will not constitute a credit agreement as envisaged by the Act. Examples of underlying causes of action not governed by the Act include incidental credit agreements, delicts, lease of immovable property and movable property rental agreements.
